Terms and Conditions

Please carefully read our General Booking, Cancellation, Payment and other Terms which apply to all bookings with CF Divers Pte Ltd.

1. Definitions

CF Divers Pte Ltd shall be construed to comprise “the Company”, as well as all their affiliates, officers, agents, employees, workers, directors and representatives.

2. General Booking

2.1 All customers must show proof of diving certification from a recognized and equivalent certifying organisations if taking part in any non-entry level diving activity.

2.2 All customers must complete and sign the relevant Liability Release and Assumption of Risk Form before commencing any in-water activities.

2.3 The Company is not permitted to dispense any medical advice. If you are unsure of a medical matter related to diving or otherwise, please seek advice from a certified Medical Practitioner before engaging in scuba diving or similar activities.

2.4 Upon signing up for any diving course, irrespective of previous experience or training, the Company requires each student to complete a Medical Questionnaire.

2.5 The maximum depth permitted on all Company vessels is 30 metres for Open Water Divers with the Deep Adventure Dive certification, Advanced Divers, Rescue Divers, Divemasters and Instructors. Open Water Divers without any additional Deep training will not be permitted to dive deeper than 18 metres. If a diver has received prior Deep Dive training then the absolute maximum depth permitted is 40m.

2.6 The Company reserves the right to modify and/or cancel diving arrangements for the reasons listed, but not limited to, those below:

2.6.1 the number of customers scheduled for the trip;

2.6.2 weather conditions making the trip to the scheduled destination not possible;

2.6.3 other ensuing technical difficulties.

2.7 Customers or students who fail to participate in any dives on a dive tour or any course training dives, for whatever reason, shall not be reimbursed by the Company for any unused or uncompleted portion(s) of the tour or course.

 

2.8 The Customer agrees to study independently and to complete the specific learning requirements for the course as outlined in emails from the Company and as shown on the Company website. This includes completing all course study objectives using SSI Digital or e-Learning in advance of arriving to begin the course as agreed. If the Customer arrives to begin the course but has failed to complete assigned work ,or if the Customer fails to arrive on time, it may be necessary to make up the work and continue the course at a later time. The student will be responsible for any additional costs and/or inconvenience this causes.

2.9 Safety is the number one priority at CF Divers Pte Ltd and if our Instructors' believe that a student is not sufficiently competent to dive safely at the level they are trying to achieve after they have finished the course and after we have exhausted all efforts to make them a safe and competent diver, the student WILL NOT be certified or may receive a lesser certification than the one expected, with less responsibility attached. PAYING FOR THE COURSE DOES NOT GUARANTEE CERTIFICATION.

2.10 Travel Documents: Participants are to ensure that they have a valid travel visa (if required) and an international passport with a minimum of six (6) months validity from the date of departure. Participants are to bear any additional charges incurred by failing to undertake this responsibility.

3. Insurance

3.1 Effective from 15 July 2015 and under the Singapore Tourism Act, all Singapore Travel Agents are required to offer travel insurance to outbound customers, specifically in relation to the insolvency of Travel Agents for trip payments of SGD 500 or greater. 

3.2 Customers are strongly advised to secure appropriate travel insurance, with a reputable insurance provider, and applicable to the activities they will be undertaking. Such insurance should provide comprehensive coverage of at least the following; Diving, Medical, Travel, Personal Liability and Cancellation provisions. The Company shall not be held responsible for any resultant financial or personal loss or injury where customers choose not to secure such insurance.

 

3.3 The Company shall not accept any liability for the loss or damage of any luggage or dive equipment whilst on board the boat, nor during the transfer(s) to or from the boat.

4. Payment and Cancellation Charges

4.1 The number of dives in any dive trip or dive tour is an estimate based on usual diving circumstances, and not a guarantee. Where circumstances arise, such as, but not limited to; adverse weather conditions, personal illness, technical difficulties, dive site remoteness/inaccessibility or personal choice, and cause a reduction in this estimated number, there will be no partial refund in such circumstances.

4.2 In the event of currency fluctuations, increases in airfares, resort/hotel rates, etc., prices for dive travel packages are subject to change without prior notification. No surcharge will be levied if full payment had been made prior to price revision (if any) except where government taxes (local GST, marine park fees, fuel surcharge etc) are introduced or increased.

4.3 For Singapore diving. You must book and pay online or bank transfer to receive a confirmed booking.  If you do not show up for the trip due to whatever reason on the day of diving itself, there is no refund or re-booking.  If you cancel within seventy two hours (72) hours prior to the trip, there is no refund unless a replacement diver can be found and they book and pay.  There is admin fee of SGD 50. Shared local dive package must be utilised within six months from date of purchase, there is no refund on dive tours not utilised.

4.4 For all ex Singapore trips. You must book and pay online or bank transfer to receive a confirmed booking.  If you cancel within 90 days, no refund can be given unless a replacement diver can be found.  No refund in full or in part, exchange or fee adjustment will be made in respect of accommodation, meals, dives, transportation, equipment or any other services outlined in the dive travel package which are not utilised.  If CF Divers Pte Ltd finds a replacement booking for you, a refund will be issued.  The value of this refund will be determined on the price of re-selling the cancelled position less an administration fee of SGD 100. Please note that customers purchasing a cancelled position usually look for a “last minute cancellation discount” from the original booking value.

4.5 CF Divers Pte Ltd does not take responsibility or provide refunds for inclement weather & current conditions, poor visibility, acts of nature, airline strikes, technical transport problems, wars or virus epidemics in the region. However, under Singapore Company Law and the Singapore Travel Agents Act, in the event a trip is cancelled by CF Divers Pte Ltd, due to insufficient numbers, a full refund is required to be given to customers.  Customers can also request to reschedule their trip to another weekend, subject to availability. CF Divers Pte Ltd does not deduct any fees from refunds given.

 

​4.6 No refund will be entertained for any medical or personal reasons that fall within 90 days for all CF Divers Pte Ltd trips prior to dive travel departure, unless a replacement booking is found.

 

4.7 CF Divers Pte Ltd will do everything within its abilities to find a replacement booking, however these can not be guaranteed.

 

​4.8CF Divers Pte Ltd does not allow bookings to be transferred to another date, unless a replacement is found.

 

​4.9 If a student has purchased a course with the trip (ocean dives) price included and cancelled the course or the trip within 90 days, the cost of the trip will not be refunded unless a replacement can be found. 

 

4.10 If a student cancels the training course after theory and pool sessions have been completed but prior to the open water dives in the ocean, a refund will not be issued.

 

4.11 Promotional course prices are NOT refundable.

 

4.12 If a customer requires emergency evacuation and the boat must return to land, the Company shall not accept any financial responsibility for any ensuing itinerary changes.

 

5. Customer’s Obligations

5.1 Where the customer is negligent or irresponsible, and causes any damage to, or loss of property and equipment belonging to the Company, the customer shall recompense the Company in full, to the current market value of any loss or damage.

 

5.2 The customer undertakes to be physically, emotionally and mentally prepared and fit to participate in the activities they have signed up for. Any resultant injury or discomfort borne out of any unfitness shall not provide any ground for complaint or refund.

 

5.3 Where Customers are physically, mentally or emotionally unfit to dive, demonstrate a distinct lack of respect for or handle/harm marine life, consume alcohol between dives, or fail to abide by general international safe diving standards and practices, The Company, represented by any of its Instructors, may prohibit an individual’s participation on a dive(s)

 

5.4 When taking part in a SSI course or Program each customer is responsible for obtaining authorization from a doctor in the event that they answer “Yes” to any questions on the Medical Statement that is provided in advance by the company. If the customer arrives on the morning of a course or program and is subsequently unable to continue due to a “Yes” answer on the medical form with no approval from a doctor, any deposit paid will be forfeit and the customer will be liable for any additional costs incurred.

 

5.5 The customer is responsible for being aware of specific requirements of the course they are undertaking as outlined in the emails from the Company and the information provided on the Company website. If the customer is unable to complete any of the performance requirements that are specifically mentioned in correspondence with the Company, such as the 200 metre swim and 10 minute swim / float, the customer will not be able to continue the course and any payment made will be forfeit and the customer will be liable for any additional costs incurred.

 

6. Personal Data Protection Act

Under the Personal Data Protection Act 2012 (PDPA), it is mandatory to recognize both the rights of individuals to protect their personal data, including rights of access and correction, and the needs of organisations to collect, use or disclose personal data for legitimate and reasonable purposes.

 

For this clause, customers are deemed to have agreed to be included in our mailing list once they have signed up an online account or made payment with CF Divers Pte Ltd for booking of courses and diving trips.  We endeavor to only send out a weekly email for trip updates and promotions.  Customers can choose to opt out of the mailing list at any moment.

 

CF Divers Pte Ltd takes a consistent effort to shoot photos and videos of divers and students during every trip for marketing purposes and for sharing with customers.  By consenting for photos and videos to be taken by our photographer during the trip, customers are deemed to allow their photos & videos to be shared on our social media platforms and collateral and used for other marketing purposes.  Should there be a concern on the use of their photos and videos for marketing purposes, customers may inform us in advance during the trip.

 

​By making payment/ signed up an online account for any program/trips or courses, you have deemed to have to us to collect your personal data  for any or all of the following purposes:

 

​(a) performing obligations in the course of or in connection with our provision of the goods and/or services requested by you;

(b) verifying your identity;

(c) responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;

(d) managing your relationship with us;

(e) processing payment or credit transactions;

(f) sending your marketing information about our goods or services including notifying you of our marketing events, initiatives and promotions, lucky draws, membership and rewards schemes and other promotions;

(g) complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;

(h) any other purposes for which you have provided the information;

(i) transmitting to any unaffiliated third parties including our third party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes; and

(j) any other incidental business purposes related to or in connection with the above.

 

​We may disclose your personal data:

 

(a) where such disclosure is required for performing obligations in the course of or in connection with our provision of the goods or services requested by you; or

(b) to third party service providers, agents and other organisations we have engaged to perform any of the functions listed in clause above for us.

 

The purposes listed in the above clauses may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

We generally do not transfer your personal data to countries outside of Singapore unless required for the organisation of overseas travel or trips.

 

7. Rights To Change

7.1 CF Divers Pte Ltd reserves the right to change, alter and / or delete these terms and conditions as well as any program outlines without prior notification.
